Introduction
Throughout the following terms and conditions and privacy policy, “the Clinic” (“us”, “we”, “our”) refers to Dr D.E. Houghton acting as a sole trader. The purpose of the website (the “Site”) is to provide information and appointment booking for specialist facial aesthetics services (the “Content”). Website Use
By using the Site you agree to be bound by the following terms and conditions. These terms affect your legal rights, responsibilities and liabilities, so please read these terms carefully and ensure that you understand them. By using the site, the Clinic assumes that you agree to the following terms and conditions. The Clinic only grants use and access of this Site, its information and services to those who have accepted its terms. If you do not agree to any of the following terms and conditions, please cease using the Site immediately.
It is a breach of our terms and conditions to use this website in any illegal, immoral, irresponsible or otherwise unintended manner. This includes but is not limited to any unauthorised access, data scraping, harassment, or defamatory content. In the event of a breach of terms and conditions as a result of illegal usage, we do not assume liability over the offending party. No Content on this website will constitute acceptance of a contract with the user.
Age Restriction
You must be at least 18 (eighteen) years of age before you can use the Site. By using the Site, you confirm that you are at least 18 years of age and you may legally adhere to this Agreement. The Clinic assumes no responsibility for liabilities related to age misrepresentation.
Medical Disclaimer
The Content displayed on the Site is for informational purposes only. We do not assume liability over any reliance on the Content. The Site is not a substitute for medical advice and is not to be treated as such.
Results
No guarantee of results can be made. Individual results may vary from person to person. The Clinic has a no refund policy on any treatments performed. Images showing patient treatment at the Clinic that are displayed on the Site fall under the same terms and conditions as the rest of the Content displayed on the Site, i.e. the images are informational only and may not be relied upon to suggest that a condition or warranty has been breached in any contract completed between any patient and the Clinic.
You understand that in the event of any complications following any service performed by the Clinic for you in a contract agreed upon and carried out between you and the Clinic, that you will be expected to seek expert medical advice at a licensed hospital at your expense.
Treatment courses
All treatment courses must be paid in full or otherwise in a pre-arranged payment agreement between you and the Clinic before the Clinic will start the treatment. All treatment courses have an expiry date of 12 months from the date of purchase. Any treatments left unused after 12 months will be automatically redeemed. The Clinic bears no responsibility to notify a client that their unused treatment is approaching or has passed the 12-month date of redemption. If you cancel your appointment within 48 hours of its scheduled time or fail to show up to your appointment, it will be assumed that you have forfeited the treatment and the contract will be deemed satisfied and complete.
Bookings and deposits
The Clinic holds a strict 48-hour cancellation policy. Upon receiving confirmation of your appointment, we reserve the right to ask for a deposit. The Deposit is not refundable but is deducted from the treatment provided.
Should you wish to cancel your appointment more than 48 hours prior to your appointment, your Deposit will be fully refundable. Should you decide to reschedule your appointment, your Deposit will be secure and will remain on your account until your next visit. Any Deposit which has not been redeemed or utilised within 12 months to date of booking will expire and the contract will be deemed satisfied and complete. The Clinic bears no responsibility to notify a client that their Deposit is approaching or has passed the 12-month date of expiration. Non-attendance and/or failure to cancel or reschedule an appointment will result in the appointment and Deposit being forfeited and the relevant contract will be deemed satisfied and complete.
In the interests of maintaining a safe and secure environment on the premises, and pursuant to the Age Restriction clause, we ask that you do not bring children with you on premises. Should you breach this term, this will result in the appointment being cancelled and the Deposit and treatment being forfeited.
You must notify the Clinic via Email (drdeborahclientmail@gmail.com) should you wish to cancel or reschedule your appointment within 48 hours of the appointment date in order for your Deposit to qualify for a refund. Cancellations under any circumstances including but not limited to sickness, Force Majeure, COVID-19 or request to amend your appointment after this time frame will result in your full booking deposit being lost and you will forfeit the treatment if it is part of a treatment course.
Treatment contraindications
During your consultation, your medical history will be assessed and any contraindications to treatment will be discussed. Please note treatments are not deemed suitable for pregnant or breastfeeding clients.
Treatment suitability
The Clinic reserves the right to refuse treatment if the Clinic deems the client unsuitable. This may be on the day or at any stage throughout the treatment or treatment course. If you are deemed unsuitable to progress with treatment, any fee paid for treatments not completed will be refunded to you in full. This full refund includes the Deposit. In the event you are unsuitable to progress to treatment, consultation fees will not be refunded. Any additional costs incurred (including but not limited to travel to and from the premises) will not be compensated.
Consultations
Consultations are valid for a period of 6 months from the date of consultation. Should you elect not to go ahead within the 6 months, a further consultation and pursuant fee will apply.
Contact Form & Appointments
The process for booking an appointment is provided under the “Contact” section of the Site and can be completed via submitting a message on the contact form. You acknowledge that submitting a message on the contact form does not guarantee acceptance of appointment until explicitly confirmed by the Clinic. You acknowledge that submitting a message on the contact form does not guarantee a reply.
When you provide information to the Clinic, you certify that the information is accurate and complete. Upon submitting information to the Clinic, you certify that you have read, understood and have fully consented to our terms and conditions and our privacy policy.
Intellectual Property
You agree that all materials, products and services provided on this website are the property of the Clinic, its subcontractors, affiliates, directors, officers, employees, agents, suppliers or licensors including all copyrights, trade secrets, trademarks, patents and other intellectual property at present and in future with no limitations or expiry (unless limitations and expiry are bound by law). You certify that you will not reproduce, redistribute, copy or publish the Clinic’s intellectual property in any way, including electronic, digital or new trademark registrations. This agreement clause applies to any future company, organisation or partnership that may come about as a result of any purchase, merger or acquisition by the Clinic.
You grant the Clinic a royalty-free and non-exclusive licence to display, use, copy and transmit the content you upload and publish. For issues regarding intellectual property claims, you should contact the Clinic in order to come to an agreement.
Limitation of Liability
The Clinic holds no liability over any Force Majeure, technical faults, downtime, errors or delays in displaying or loading the Content on the Site. The Site may display web links to third-party websites that the Clinic deems useful or relevant. Pursuant to this, the Clinic holds no liability over any content displayed on any third-party web links.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. All amounts, indications and references to money are given in GBP.
